our landlord is evicting us for non payment of rent. the thing is, we paid the rent but she doesnt remember it. even though i have the receipt. she doesnt remember anything you talk to her about. we pay the rent and a few days later she calls and asks for it again. its happened a few times but this one time i lost the receipt and couldnt find it. i ended up paying it again just because i didnt want to hear her complain about it and argue with her.. i did it in hope i would find the receipt and be ahead in my rent. well 2 weeks go by she calls and asks for rent again. by this time i had found the receipt and i told her we were paid and she didnt want to hear it or even see the receipt. meanwhile most of that time i was out on workers comp because i got hurt at work, we explained to her weeks ahead of time that there would be a transition period when i went back to work. explained several times to her that i would probably have to work a week or 2 before i got paid, she said not to worry about it pay me when u get paid blah blah blah.. we also explained it to her again the day i knew i was going back to work.. again she said the same. we were only 1 week behind $200..when we received the 14 day notice saying we owed $800 when we only owed $200. we got that notice the same day i got my first paycheck being back to work. i came home my wife said we got the 14 day letter and i went right downstairs with the $200 we owed her plus another weeks rent. she refused it and slammed the door in my face..a few weeks later my wife talked to her and the landlord said she wanted to work something out..2 days later my wife went down there with some money to give her and again she refused it and didnt ever remember talking with my wife. these things have been going on since we have been here. i have several times paid the rent early and she still calls and asks for rent money.. how do i present this to the court, since then i am behind on the rent due to losing my job after i came back from being injured. but i am not behind as much as she claims..also the apt has lead paint and we were not told the whole story about the lead paint.. she said it was only in a certain spot. we didnt think it was a big deal because the spot she said it was the kids cant reach and are not accessible to them. come to find out its everywhere and she didnt notify us with the proper paperwork. and the 3rd thing is. her son has power of attny over her, can she legally sign any papers. i assume he knows his mother has dementia and has taken power from her. but she wont give me his number to talk to him because i think she is affraid of being put in a nursing home...and finally we went to court today and the court said she didnt file any papers with the court she has to redo the whole process... does that mean a new 14 day notice too?? any help would be appreciated thanks..

If the service of the notice was proper, she just has to start again with the other parts of the eviction (Complaint/Summons). If I were you, I'd look for a new apartment. If you go to court and explain your situation to the judge, as long as you have paid the rent, you should be OK. But getting a demented, elderly woman to clean up the lead paint issue is not going to be easy. It sounds like a mess.

i got a lawyer today. she's gonna take care of it. she said the case may be dissmissed just on the fact the lady wouldnt except the rent
