went to an open house for 3 unit condo complex,1 unit sold already. asked sellers agent about the fenced in yard. he told us it will be a common area split among the 3 units (3 units in complex). MLS listing shows yard in photos. When we get the P+S, after we have reviewed and are close to signing, the seller's agent calls our broker to vagueley discuss "THE BACKYARD". states its on 2 lots, but that the seller owns both and is deeding the backyard lot to condo assoc. NOTHING of this is mentioned in P+S(or ever before thsi call-and we had been in contact for 2 months!!). our lawyer calls seller's lawyer who states seller DOES NOT OWN THE YARD!! reviewing deeds shows P+S was only conveying the building, nothing behind it. we spent 400 on inspection and 500 on plumber(and many many hours)to get this sale to go through, based on false and misleading practices. can we get our $$ back. also, the seller established a Realty LLC in an attempt to protect her personal assets, but i believe this menas she is subject to 93A. i sent a demand letter to her, her LLC, the broker and the realty firm. havent heard back.
