Hi,

My girlfriend is represented in her medical malpractice case by a criminal defense attorney. Why? I do not know.
Her case is being negotiated they are trying to come to a resolution the plaintif's do not want to go to court. I want to know if they agree to a figure a settle is it common or standard practice that the plaintif's pay the attorney's fee or basicaly what I'am asking is do the lawyer take the money from his clients settlement or does ask in addition to the settlement that his fees are paid.

The attorney will be paid according the terms of the retainer or fee agreement that your girlfriend signed when the attorney was hired.

If the attorney was hired on a contingency fee, that payment will come out of, and be based upon, the settlement figure. Again, this will be based upon the fee agreement.

IM TRYING TO FIND A LAWYER THAT WILL SEE IF I HAVE A CASE I DONT KNOW WHAT OPTIONS TO TAKE ,I HAD MY TUBES TIED IN FEB 2007 AND ENDED UP PREGNANT IN JUNE 2008 ABOUT 9 TO 11 WEEKS AND I SPOKED TO SEVERAL LAWYERS AND BASICLY I NEED TO BE DEAD IN ORDER TO FILE A SUIT ,THEY DONT KOW IVE SUFFER ENOUGH ,ITS HURTS SO MUCH THAT NO ONE CARES ,THAT DOCTOR DID NOT TAKE CARE OF ME LIKE HE SUPPOSSED TO HE VALATED MY RIGHTS IVE WENT THROUGH SO MUCH PAIN AND SUFFERING AND NO ONES TO BLAME THATS VERY MESSED UP?
