Mass Unemployment Adjudicator made horrible error, family of 4 about to be homeless before Christmas
A friend of mine was recently denied unemployment because his former employer alleges that he walked off a job, then quit.
This is untrue.
In fact, the "employer" was labor ready. My friend only went there out of desperation, but questioned about a dozen health, safety and employment law violations (forcing employees to ride with staff, then deducting 10 per day for rides, charging for paycheck, zero safety training, and more) after raising the flag, then arriving on a job site to work with 3 other guys who were sniffing BATH SALTS while working, one was driving a fork truck...my friend called the labor ready office and voiced his concerns. The manager called him back and said to work through lunch and get back to the office by 3pm. My friend got there, then refused to sign a form indicating he quit the job after noticing that for a 7.5 hour workday his pay was 37 dollars and complaining that their math Did not add up. The manager gave him a number to call to file a grievance, and told him to continue to call in daily before 7am if he wanted work.
My friend filed a non payment of wage complaint, and a complaint with the employment agency licensing dept. He continued to call daily looking for work. The day before thanksgiving the manager called him, told him that they don't have work for snitches, and said not to call anymore
My friend was denied unemployment because labor ready said he quit, which is not true. He was given the opportunity to fax any supporting documents over to the adjudicator, which he did. He sent phone records proving calls to the whistleblower line, outgoing AND incoming calls from the Labor Ready office, copies on the non payment complaint, and the unsafe environment complaint. He also wrote a detailed statement outlining the events
The adjudicator still disqualified him, saying he quit his job. I don't think the adjudicator looked at the documentation. Phone records and complaints tithe AG office seem to be compelling, but they meant nothing
Now, he's got 2 kids and a sick wife. They were denied other help due to the unemployment disqualification (can't quit a job and expect welfare to help) and are very close to loosing their home, they're not barely eating, and the kids won't see a Christmas.
He obviously is going to appeal the decision, but that'll be weeks. Can he collect while waiting on the appeal hearing? In this case, they're destitute. Or, can someone just look at the phone records, complaints, and statement and see that there was a mistake and approve the claim even though the adjudicator denied it? It's impossible to get anybody on the phone there.
How is this fair?
