Mass Family Law - Contempt Filing - Health Care for kids - bills

My wife is filing contempt order against her ex. Part of the issue is failure to provide health insurance for his children as ordered by the court. There was a doctor visit by my stepson that was scheduled by my wife before the health insurance lapsed but when the services were rendered there was no health insurance in place(unbeknownst to her) so the full amount was charged to the husband. He paid ½ of the bill and expects her to pay the other ½ of the bill. My wife refuses because if he had maintained the insurance as ordered there would be no bill.

My question is How will the judge view this – should we pay the ½ even though the bill would not exist if there was health insurance in place or do we leave it to the judge to decide? I don’t want to contaminate the judge’s view of her because she did not pay the outstanding bill when we should have.

Health Insurance

Every Judge reacts differently to contempt situations. You and your wife seem to understand the process and have a compelling case to have the father pay the total bill. I do not think this will reflect negatively on your wife at all.
