My wife and I are thinking about suing her doctor because of a surgery mishap, but my brother told me cases are hard to bring in Massachusetts because we have some kind of tribunal that must approve the case. What is that?

Yes, Massachusetts medical malpractice cases must go before a medical malpractice tribunal before proceeding to trial. However, the burden of proving the merits of the case in front of the tribunal is relatively low, and an experienced medical malpractice attorney would likely not have taken the case in the first place if it was not strong enough to satisfy the tribunal. Also, even if the tribunal rejects the case, the plaintiff can post a $6,000 bond and proceed with the litigation.
