I am employed at a private non profit that grants four weeks paid maternity leave after 12 months of employment. I am pregnant and my due date is on the exact same day as I will complete 12 months here. Therefore I will not get paid leave and disability benefits if the baby comes early. However I noticed that I have to use up vacation time and sick time before the leave anyway. So, could I legally plan to use my vacation time in the weeks around the due date and then collect on the paid leave even if my baby arrives early? i.e. I would not be using the paid maternity leave until after the 1-year mark regardless of the baby's arrival date.

If I understand your question correctly, you are not really asking about Massachusetts law. This seems like a policy question that you need to take up with your Human Resources Department. Having said that, If you have accrued vacation time, I don't see why they would object to you using it around your due date. Good luck.
