My wife and I bought a contemporary tri-level home in Massachusetts in 2000. We are putting our home up for sale this year.
When we bought the home in 2000, the living area was listed as 3284 square feet which included 800+ square feet of space on the ground floor. We have recently been told by real estate agents and a real estate appraiser that current State Law does not recognize the 800+ square feet as living space because part of the space is below grade. Without including the 800 sqft, our home appraises for less than it should.

I do not know of a MA law or regulation on this point and assumed it was based on standard practices in the area. (However, that certainly does not mean there isn't such a law or regulation.) Why don't you ask the appraiser and real estate agent what law they are referring to and then post the answer to enlighten us all?
