Legal to Rent Spare Bedroom?

MA Landlord and Tenant Law Questions and Answers

My wife and I live in a three bedroom house in Quincy MA. We use only two of the bedrooms and are considering renting out the third. Is it legal to do that in MA? I know that in some places in the U.S. it is not. Thanks for any help.

I'm not aware of any Massachusetts law that would prevent a person from renting out a spare bedroom (assuming the room satisfies the Housing and Sanitary Code). I suppose there could be local ordinances on the subject, but do not know. Call the inspectional services department in Quincy and ask. You will need a certificate of occupancy in any case, so that is a good place to start.
