Is it right that an employee lays someone off then doesn't ask the lay-off if he wants his job back then hires someone for the same exact job?

Sorry about your situation.  However, as you may know from reading other posts on this Forum, employers can fire at will employees for any legal, non-discriminatory reason.  Absent some contractual obligation, such as union contracts or--in some cases--the employee handbook, your employer is not under any obligation to re-hire you when it is ready to expand its workforce.
