My landlord emailed me today that she is having a family situation and needs our apartment starting January 1, 2010. We have a lease through August 31, 2010. There are 5 of us living here. Can she do this? She has not sent a Notice to Quit yet, just the email and a voicemail message. We do not think she can legally make us leave on such short notice. Aren't we protected by our lease?
What can we do to fight this?

No, you do not have to move out. If you have a lease, you can only be evicted if you somehow violate the terms of the lease AND a judge order you to move. Even with a tenancy at will, proper written notice must be served and you still do not have to move until a judge grants possession of the unit to the landlord. Good luck.
