I RECEIVED NOTICE OF A JUDGEMENT LEVIED AGAINST ME FOR WICH I HADN'T BEEN IN COURT FOR DUE TO MY NOT RECEIVING NOTIFICATION BECAUSE I HAD BEEN AWAY. AT THE TIME I WAS ON SSDI AND STILL REMAIN SO. A SUMMONS HAD BEEN ISSUED FOR A NEW COURT DATE FOR NON PAYMENT. I IMMEDIATELY CONTACTED THE ATTORNEYS/COLLECTION AGENCY AND FAXED THEM PROOF THEY REQUESTED IN THE FORM OF MY AWARD LETTER. I WAS THEN TOLD THAT THE SUMMONS WAS NULLIFIED?? SOON AFTER I WAS CONTACTED BY THEM AND TOLD THAT I WOULD STILL NEED TO GO TO COURT AND COMPLETE A FINANCIAL STATEMENT WITH THEIR ATTORNEY TO PROVE MY INABILITY TO PAY. AT THE TIME I WAS OVER 1000 MILES AWAY WITH NO WAY TO BE THERE AND WAS TOLD AN ARREST WARRANT WOULD BE ISSUED IF I DID NOT APPEAR.
SOON AFTER THEY OFFERED ME A PAYMENT OPTION OF $100 A MONTH TO REPAY DEBT AND TO POSTPONE FOR 3-4 MONTHS THE COURT APPEARANCE...WHICH I AGREED TO.THE DEBT IS A LOAN NOT TAXES OR CHILD SUPPORT.I'VE MADE 3 PMTS TO DATE AND NOW MY QUESTION IS WHY DO I STILL NEED TO GO TO COURT,I'VE GIVEN THEM ALL THE PROOF THEY REQUESTED AND I'M OK WITH "VOLUNTARY PAYMENTS " AS THEY NOW CALL THEM.
