My mother transferred her house to me by deed about 3 years ago. I think there was some confusion of her part as after reading up on it, this may only reduce the amount Massachusetts Medicaid can see for reimbursement of funds. We discussed it and decided to place the house into an irrevocable trust.
Before I consult an attorney, should this be an inter vivos or testamentary irrevocable trust? Does putting the house in trust disrupt the 3 year period the house was transferred to me by deed?

Trusts and Medicaid planning
Establishing trusts for complex purposes, such as Medicaid planning, is one of those areas of the law that really requires some professional help. The stakes are high because of the value of the asset in question, and the answers may vary depending on the unique situation involved. Honestly, with the information given, I'm not sure how the transfer will impact her eligibility, and I would talk to an estate planning attorney before taking any other steps regarding the house. Good luck, and sorry I can't be more help.
