I'm getting a little confused from reading the other posts in this forum about my personal injury claim (potential claim because I have not sued). I had a car accident and my car was damaged and I had one hospital bill for the emergency room for $750. But my car insurance paid for the car repair and my health insurance paid for the hospital bill except for a $75 co-pay. So, the other woman was clearly at fault in this accident and I'm always hearing about people getting to sue if they get in an accident but how does that work for me? How can I sue if my insurance covers all the damages?

LOL. Wow, there are a lot of people who wish they had your problem. Consider yourself lucky. If you have considered all possible damages that could have resulted from your accident and still believe that you are only out $75 from your own pocket, then you are doing OK. The law isn't a lottery, and you didn't win. People sue for damages in personal injury cases to make themselves whole, usually after suffering terrible injury and damages. However, if you think you have other damages, such as lost wages, you may want to consider talking to a Massachusetts injury lawyer. He or she will be able to help you determine if you are overlooking any other possible damages. Good luck.
