Injury from defective property in MA

Three weeks ago I was visiting my friend at her apartment building I tripped over carpet on a stair in the stairwell and suffered some bad injury. How bad does the defect have to be or will the judge just say I was clumsy and throw the court out. Does MA law talk about this at all?

Typically, based on Massachusetts law related to personal injury and negligence, it is enough to show that a dangerous defect existed, that the owner of the property knew of the problem, and that he or she allowed the defect to exist for an"unreasonably long time" (generally, longer than a reasonable person would have allowed the defect to exist).  I assume you have taken care of your injuries.  Now, take a picture of the defect if you can and then contact a Massachusetts personal injury lawyer.  Good luck.  For more information about premises liability, check out our Massachusetts Personal Injury Discussion Forum.
