I moved into my apartment on July 1st. On August 18th my landlord told me the fire department were coming to check the fire alarms and would need access to my apartment. I stayed home (since i have a cat) and when they came, it turned out NOT to be the fire department but the Zoning Commissioner - telling me that my apartment was "Wrong". I asked what he meant and he told me to call him the next day.

I called the next day and was told that my building is zoned for 5 apartments - but there are currently 6. MY apartment is supposed to be the second AND third floors.

Entering my apartment you go through one locked door and then my apartment door (which also has locks). The zoning commission tells me that the FIRST door is the door to my apartment, and that the landlord has to remove my "Front" door as it's not legal.

I also believe the upstairs "apartment" has been using my electricity, which i've been paying for- as it's only zoned for 5 apartments, not 6.

The upstairs has a washer/dryer and two more bedrooms.

My questions is this- if the zoning commission force my landlord to remove my front door, and say that the other door is my apartment entrance, then the third floor is mine too yes ??

I really just want to move because everything is very strange and scary ( i found out that a double wall socket behind my bed has NO WIRES !!!).

Can i get out of my lease ? if so, can i force my landlord and/or realtor to pay for my moving costs (it just cost me almost $6000 to move in July !!).

Do i have an recourse against the realtor and/or landlord ??

If no, do i legally have a right to the third floor if the only entrance to both floors is my apartment door (which was NOT the only entrance before the zoning commission came ).
