A tree fell on my roommates car while parked in the driveway. She did not have comp on her car insurance (not sure if they would pay anyways) and those damages where not covered under the landlords homeowners insurance. She is now going after the landlord in an attempt to obtain the money from him. The car was only worth about 500$ (best case). Who is liable?

Sometimes nobody is liable. if your friend did not pay for insurance that covers the type of damage she sustained, then her insurance co. is not liable. Unless the landlord was negligent, perhaps by allowing a dead tree to stand by the parking area, then he is not liable.
