How long do temporary orders take in MA divorce?

I've got a hearing next week on our request for temporary order for things like sale of the home and child support. I was wondering if my husband and I cant agree on this stuff how long does it usually take the judge to make the order. Will he do it right at the hearing or will I have to wait?

Temporary orders in MA divorce

First, for those who do not know, after the defendant has been served in a MA divorce, either or both parties can file motions for temporary orders.  In essence, the party filing the motion is asking the court to decide such things as who will have physical custody of the children, who will have legal custody of the children (and, thus, be able to make decisions for the kids), which spouse will move out of the house, what visitation will be allowed, and whether there will be any child or spousal support ordered.

If you are able to resolve the issues before you get before the judge, then she merely reviews the agreement and enters it as the temporary order.  Follow this link for more information about the divorce process in MA, including temporary orders.  Just so you know, before you go before a judge, you and your spouse will initially be sent to a "Family Service Officer" or a "Probation Officer" to try to iron out your differences regarding the temporary orders and other issues. If no agreement can be reached then, in most cases, the judge will take it under advisement and and make her order within a week or so of the hearing date.  Good luck.
