Homeowner Association Fines.....are they legal?

My HOA is fining residents, but there is no statutory authority to do so. Condos are authorized to levy reasonable fines, but HOAs are not subject to GL 183a.
Is there any case law here? My understanding is that HOAs are fining their residents all over Massachusetts.

HOA fees and fines

Yes, although Massachusetts has little law on the subject they are legal.  When you purchased the home, your deed contained certain language that authorizes the Home Owners Association to enforce certain specified rules.  However, that does not mean your HOA can fine for anything at any time.  There are limits based on the documentation established by the original developer.  If you feel you are being unfairly fined, or if the HOA is not applying the rules fairly, talk to a Massachusetts attorney.  Good luck.

Too Late!

It would be ridiculous to hire an attorney and spends thousands of dollars! I filed my own complaint in Superior Court.
I believe that fines are a statutory power, and can't be acquired by any private organization.
It is ludicrous to think that a private entity can empower themselves with this extraordinary remedy, especially when it concerns property. It is shameful that the legislature empowered Condo Associations with this power, without even a nod to due process, fair procedure or impartial tribunals. But we know how hard those Condo lawyers lobby don't we?
And people wonder why we think so little of our politicians.
