If a homeowner has someone living in their home (not a relative) who has no lease and pays no rent, have to give any notice, such as a 30-day notice, to leave their home, or can the homeowner ask that person to leave at any time?

If this is truly a guest, someone who never paid any rent, at any time, then you can simply ask him or her to leave.  If she refuses to go, the police should be contacted.  If the person paid rent at one time, then you should follow standard eviction procedures.

renting with non-lease agreement in private home

I rented my home to my ex-wife because she came to me for help after leaving her 1 year marriage to another man. I felt sorry for her & let her move into my house. I moved into my girlfriends house & left all my furniture for her to use (including my bed & TV's) There was no lease agreement. It was verbally discussed that she would pay whatever the mortgage was ($628) & all utilities. Now after 3 months...she refuses to pay the water bill for the next 6 months (I paid the first 6) Also she was short $400 on the 2nd month rent in which I had to pay because my mortgage co. was calling that they did not receive payment. She was all the utilities bills late. It was a bad idea to rent to an ex! I told she needed to find another place to live. She is a paralegal & told me to send a 30 day legal eviction notice to her. (Great...using the law now to her benefit) How shall I handle this mess? She's only been renting for 3 months...she needs to get out so I can take my house back. Is she considered a guest with no lease? She has been paying my mortgage late for a couple months now. How can I get her out??????

She is a at-will tenant.  Give her a 14 day notice to quit for failure to pay rent.

She claims she pays mortgage!

She paid all the mortgage payment late & I gave her a check for $400 made out to her on the second month...Ii have proof of that)...so she can pay the mortgage. now she is refusing to pay the next 6 months water bill of $230 also. So what you are saying is I can send her an eviction notice to get out in 14 days...even if she claims that she pays the mortgage? Do I need to seek a lawyer to write a legal eviction notice?

Notice to quit

If you are evicting her for non-payment of rent, use the 14 day notice.  If you are not sure about how you want to evict her, use a 30 day notice.  You are not obligated to give a reason with the 30 day notice.  Forms are available online and at libraries.  The important thing is to serve the notice to quit properly.
