I have worked for my company for about a year and a half now. I am considered a part time employee, yet I average about 38 - 40 hours a week. This company refuses to give full time status to anyone not In management, therefore saving on paying out vacation and sick-time. They also refuse to offer health insurance to anyone part-time stating, and I quote "Go on Mass Health". Is this legal? Can they refuse full-time benefits to us that work full-time hours?

I am in a similar situation, and have been searching for the exact wording of the Massachusetts law that governs our situation.
My employer told me that they had no full-time positions available but that if I worked 40 hours or more a week for more than 12 weeks, MA law required that I be made full time. To keep me part time, after 12 weeks of working 40 or more hours a week, I must work 3 contiguous weeks of no more than 29 hours each week. I must repeat that cycle all year long unless a full time worker leaves and I can take his/her place.
