I have been employed in a medical facility for the past 9 years with excellent written reviews and letters form physicians.
Last year, i was asked to put in false billing by the manager to make up for lost revenue which I refused.. Shortly after,
I have been called in several times by her and director accused of patient complaints, hang up calls ect.. Also have been
given multiple witten warning for baseless things and have been told to look for other employment. I was also told not to
put time on my time sheet that was due be and have letters documenting this with HR. I also sent a certified letter to
state about this.. Do I have a potential case here.. They won't fire me but are harassing me to quit. I have several letters
from physicians that support me and excellent written reviews.
Help!!!!

Assuming the facts are as you describe, I would certainly talk to a Massachusetts Employment law attorney. It is clear under Massachusetts law that your employer cannot fire you because you refused to perform some illegal act, even if you are merely an at-will employee. See, for example, Federici v. Mansfield Credit Union, 399 Mass. 592, 595 (1987). The Federici case discusses the "public policy" exception to the at-will doctrine. (Under MA law, at-will employees can be fired for any non-discriminatory reason. However, there are numerous exceptions to that "rule.")
However, it is also illegal for your employer to create a hostile work environment with the intention of forcing you to quit. This strategy is known as a "constructive" termination. For more information about all of these concepts, visit our MA Employment Law Discussion Forum.
