I notified my landlord several months ago that I would be exiting my lease 3 months early. My landlord agreed, but said I would be responsible for finding a suitable replacement tenant.
In reliance on an email exchange with my landlord, I advertised the apartment as available for the remainder of my lease (3 months) with an option to renew. I have found a (potentially) suitable tenant, but my landlord now tells me the tenant must be willing to sign for a 12 month lease instead.
If the landlord refuses to entertain the application from the replacement tenant because the tenant wants to assume my lease instead of sign a new 12-month lease, is the landlord failing to mitigate the damages of my broken lease? Can a replacement tenant be made "unsuitable" solely because she is unwilling to commit to a leaser longer than the lease the original tenant is breaking?
It seems unfair to require I find a tenant not just for the remainder of my lease, but also for an additional 9 months.
