My boyfriend has my power of attorney. I had him fill out the paperwork and have a constable deliver a 14 day notice. At the appropriate time, he filled out the summary process for the constable to deliver. When my boyfriend went to file the papers in housing court today, he was told he had no authority to file the papers and that the whole process had to start over. Doesn't the power of attorney give him the right to act on my behalf?

Yes, I would have thought that would work, as long as the POA was valid. Unless it was the judge who told him, I would send him back to court for an explanation. Especially with respect to the service of the the complaint and summons, since it was actually served by the constable, I do not understand what they are objecting to (unless they want the POA to be specific to the eviction process). I had a similar experience. Just thought I'd share...
I had to provide a letter to the court signed by a Notary Public stating that I was giving the person permission to act on my behalf for this particular situation at hand.
