Fee agreement in Massachusetts personal injury case.

I just lost a case against a big box store that went to trial. This thing dragged on forever and I had some serious injuries that now I wont get any damages for. So the worst part comes now. I thought that I'd only have to pay my attorney if I won the case but now she is sending me a bill for three different depositions transcripts. How can that be the case? Is it legal in Massachusetts.

This question raises an important issue for anyone considering hiring an attorney for a personal injury case.  Your obligations regarding fees and out of pocket expenses (such as the cost of depositions and transcripts) are controlled by the fee agreement you signed with your attorney.  So, yes, it is very possible that you signed a fee agreement that requires you to pay certain out of pocket expenses.  With such an agreement, whether you win or lose the case, you must pay for those items that the agreement specifies. 

If I were you, I would take a look at the fee agreement and determine what, exactly, you agreed to pay.  If you don't have a copy of the agreement, ask your attorney to send it to you. Good luck.
