I got my H1b approved last week. I am currently on F1 visa (till September 30th 2009) and I got married in Feb 2009.
My wife is planning to come to US in June 2009 and I got a new I-20 from my university for her, so that she can come on F2(dependent visa).
Out of the below 2 CASES, which one do you prefer.
1. As my H1b is already approved, it is possible that, can she directly come on H4 visa in June 09 (which is before October 09), instead of F2? but during this time my status will be F1 (till September 30th 2009).
I know chances of this is very less, so if option 1 is not possible, then, here is the 2nd option.
2. Say she comes to US on F2, so is it possible that once she comes to US, can we apply for her "Change of Status" from F2 to H4 (in my current H1b file) before September 09 ?
Say, sometime in June 09, once she comes here in USA on F2, we have applied for her H4 - Change of Status.
If her “Change of Status” is approved before September 30th: Then automatically her status will be changed after September 30th from F2 to H4 (same as mine: from F1 to H1) and she don’t have to leave USA and re-enter US?
If her “Change of Status” is approved after September 30th:
If, by any chance, her application will be in “pending state” even after September 30th, can she stay in US after September 30th, till her H4 application is not approved/rejected ?
