Exemptions to homestead law and condominium association dues

Hello, Can a condo association seize a condo for unpaid condo fees if the condo in question is homesteaded? Thank you

Exemptions to Massachusetts homestead law

As you may know, there are certain debt or creditors that are exempted from the protections offered to homeowners by the MA declaration of homestead law.  Although this is not my area of specialty, I believe condominium association dues are an exempt debt.  So, yes, I would say the association can seek to collect the debt.   Other types of exempt debt include: (1) federal, state or local taxes,  assessments, and liens;  (2) mortgages on the property in question; (3) an execution issued from the Probate Court to enforce a judgment for support of a spouse, former spouse, or child support; (4) an execution issued from a court to enforce its judgment based upon duress, fraud, mistake, undue influence or lack of capacity; and (5) a lien on a home that was recorded prior to the recording of the homestead declaration.  Hope that helps.
