Is Employer in compliance with MMLA and FMLA under these conditions?

Employee gives birth during the 10th month of employment at given company. The company grants employee the 8 weeks of maternity leave per MMLA orders. The employee then wishes to take 12 weeks leave (as she has now been employed one year - the 8 weeks makes it one year or 12 months) per FMLA law but is denied these 12 weeks. The employer has over 50 employees, and employee has worked over the required 1250 hours for the company. Is this in compliance with FMLA or is employer in the wrong?
