I'm currently dating a man I met at work. He is not my supervisor but he is one level above me in the big scheme of things. I've been told by a co-worker that my employer has a policy requiring a "love contract" or a relationship contract signed by the employees in a situation like that. Before I look into this, is a love contract even legal in Massachusetts? It seems a bit invasive. Thanks.

Relationship contracts in MA

I know of no law or case law in Massachusetts that prohibits employers from asking employees who are in a relationship with another employee to sign a love contract, aka relationship contract.  These agreements vary in form and content, but they usually attempt to get the participants in the relationship to state that the relationship is consensual.  The contracts typically remind the couple of the employer's rules for office dating (perhaps touching on public displays of affection) and of the applicable sexual harassment policy.

Many employers like to use love contracts because, they believe, the contracts may limit the employer's liability in any sexual harassment suit if the relationship turns nasty.  Many employment law attorneys, however, believe employers may be better served by crystal clear, unambiguous polices in the employee handbook that cover all issues related to office romance and harassment. 

I don't have an opinion on the matter but I suppose such contracts may serve a purpose and are, arguably, less intrusive than a policy that simply bans all inter-office relationships.  (Some employers do not ban all relationships but do prohibit managers from becoming romantically involved with a subordinate.)  Hope that helps, and good luck with your relationship.
