My cousins been in prison for almost a year now on a three year sentence and he says he might get out early with a GPS device. Is that legal in MA? I know this guy and even though he's my cousin I don't think they should be too quick to let him out. Thanks.

Yes, it is done in some cases. There was a decision from the Massachusetts Supreme Judicial Court's in 2008 (Commonwealth v. Donohue) where the Court held that, in some cases, Massachusetts Sheriffs can release inmates wearing a GPS tracking device, even if they have not yet served the full sentence imposed by a court. You do not provide too much information about your cousin or what he was charged with, but he may not be eligible for the program. Typically, the program is only accessible to inmates who are a minimum security threat, have not had any drug infractions and have show excellent behavior while incarcerated. Sex offenders are never eligible for the GPS monitoring program.
