Duty to report crime in Massachusetts?

If I witness a person getting beat up at a party and just run away without calling the cops or helping the guy whose getting beat up, can that guy sue me for negligence because I didn't report the attack or call the police or try to help him? I've been told that I might have broken a Massachusetts law by running away. The guy who got beat up is OK but he told someone he was going to sue me. Thanks.

Duty to assist or rescue in MA

I don't think so.  In terms of civil liability (as opposed to criminal liability) Massachusetts law does not impose a duty to assist upon bystanders or witnesses.  In other words, you had no duty to try to intervene and assist the victim of the crime either during the attack or after the attack.  Accordingly, although anyone can sue another person for any reason (valid or not), I do not believe you would be found liable and required to pay damages to the victim.
 
However, Massachusetts does have a law that requires persons who are at the scene of certain crimes (aggravated rape, rape, murder, manslaughter or armed robbery), to report the crime to the police, if he can do so without putting himself in danger. See Massachusetts General Laws Chapter 268, Section 40. Given that you witnessed a simple assault, that law does not seem relevant.  Hope that helps.
