I am trying to privately sell a car that has been sitting in my driveway for a couple years now, when it was retired it was a lemon, it still starts, and a gentleman came by a few days ago and offered to buy it off me. My question is what's the highest price i could sell it at where i couldn't be penalized under the lemon law? thank you

There is no dollar amount exception to the so called "Lemon Aid Law." Massachusetts General Laws Chapter 90, Section 7N allows a buyer to void a contract and return the vehicle if it fails to pass the safety or emissions inspection within 7 days of the sale AND the estimated cost of repair exceeds 10% of the purchase price. So, if your buyer knows the car is a lemon but wants to buy it for parts or to fix it up, then he probably won't try to get a refund from you, because he will not likely attempt to get the car inspected. (Section 7N also states: "This section shall apply only to motor vehicles purchased for the immediate personal or family use of the buyer.") On the other hand, if you attempt to sell the car to someone who wants to use it for transportation, there may be adverse consequences. Good luck.
