Working for commission based company that provides commissions faded against an hourly rate at a rate of 10% gross profit and 2% gross sales, I have recently watched them deduct portions of the aforementioned percentages if an individual does not sell enough warranties to go with a product. They have basically slid this concept in the door with no trumpeting of new procedures or any other notifications of this new practice. No one sales person as far as I have ever known has signed anything that even states that they acknowledge the practice of this new rule. Is this legal? and if not what can be done? This is a multi billion dollar company. Can they legitimately sell us out to a warranty company in this manner? I've seen fellow employees lose a lot of money over this. I work in massachusetts but this company is in almost every state. It would be helpful to know the rules for each state. Thank you.
