I'm asking for a niece of mine who's involved in a personal injury case after a car accident. Her lawyer is pushing her to settle even though she does not think she should. She thinks she can and should get more money and the lawyer says no. Can the attorney force her to settle the case or is it up to her?

It is up to the client to accept or reject an offer of settlement. Moreover, attorneys in Massachusetts are obligated by their code of professional conduct to tell clients about any and all reasonable settlement offers. I know nothing about your niece's case, but typically attorneys try to do what is in the client's best interest, and if an experienced personal injury attorney recommended that I settle my case, I would consider his or her advice carefully. After all, one of the things your niece is paying for (when hiring an attorney) is experience. For more information about settling cases, visit our Massachusetts Personal Injury Discussion Forum.
