Hello,

I own and live in the middle unit of a 3 story garden style condo. The renter that lives in the unit above me is making me concerned for my property.

The renter is rather large (350 - 400 lbs). A year a go I has my ceiling plastered - everytime this man walks, the floor joists, squeak, pop and crack - I am concerned that my ceiling will crack due to his weight.

In addition, this man snores exteremly loud, where it seems he is in my room. In the 10 years I have lived in this condo, I have never heard anyone snoring (come to find out he has to wear ears plugs to not wake him self up due to his own snoring). He also has night terrors, where he wakes up screaming in the middle of the night. I am used to normal condo living noises - walking, TV's, etc.... it's just a part of condo living but these concerns are above the norm.

I have spoken to him about this. I have contact the condo association and will be cotnacting his landlord today.

My questions are:
Can I hold the landlord responsible for any damages done to my ceiling due to this man's weight?
If I call the police is there anything they can do with regard to the excessive noise from the snoring and screaming?
Is his landlord required to do anything like sound proof his unit?

Since my complaints, anytime I watch TV using my surrond sound - volume level 15 out of 100 - but the bass does vibrate during action scenes that are louder than the rest of the movie, he pounds on the floor. So it's getting to the point where I am not confortable in my own home. What actions can I take?

owners occupied with a renter above

We live in a small building of three condos. The owners of the unit above us recently moved out and rented their unit to college students. The students are nice people, but their music is SO LOUD. and they have no rugs or pads. We can hear every single footstep. I'm wondering if the people who own the unit above have any sort of obligation legally to soundproof the unit now that they are landlords and have renters. Our condo docs are useless, we've read and re-read them. There is nothing written about renting or tenants really. Now, as owners of our unit, we're screwed! We are a family with chidlren.
