Correcting mistake in deed in MA for life estate

I created a life estate but then discovered that the deed had misspelled my last name. If I do a new deed to fix the mistake will that cause a problem because it changes the date the life estate is created? Thanks for your help.

No.  You (or a Massachusetts real estate attorney) should create a document known as a "Confirmatory Deed."  This document will correct the original, will refer to the original document, and after properly recorded, will cause no problems for future conveyances.  The date of the creation of the life estate will remain unchanged (date of the original deed).  Follow this link for more information about life estates in Massachusetts.  Or visit our Massachusetts Elder Law Discussion Forum.
