I purchased a gift card in New Hampshire over the weekend and was told that if my nephew did not use it within a certain amount of time certain yearly fees would be deducted. I did not like that, but the store he likes is only in New Hampshire. I'm pretty sure that's not legal in Massachusetts, but what about in New Hampshire?

Interesting question for those of us who live close to the border. New Hampshire, like Massachusetts requires gift cards to be valid for a certain number of years. However, businesses have tried to get around that prohibition by doing just what you describe: imposing yearly charges on gift cards that remain unused for a certain amount of time. This practice, illegal in Massachusetts, is not directly addressed by the New Hampshire consumer protection law. Follow this link for more information about MA gift certificate laws.
Update regarding gift cards and certificates
New federal regulations (12 CFR pt. 205, effective Aug. 22, 2010) restrict dormancy, inactivity, or service fees for gift cards or gift certificates
