I'm divorced six years and she is now getting remarried. She recently raised the subject of letting her new husband adopt our child (I am not close to the child as they live in another state and we divorced when she was only one year-old). So if I give my consent to the adoption will I be able to stop paying child support under Massachusetts law? I know that sounds cruel and uncaring, but I lost my job and can't afford to keep sending money to a child that does not even know who I am. Thanks.

Nope. There is actually a decision from the Massachusetts Supreme Judicial Court that is right on point. In Adoption of Marlene, 443 Mass. 494 (2005), the court held that a parent's obligation to pay child support does not end with an adoption, even when the parent consents to the adoption pursuant to Massachusetts General Laws Chapter 210, Section 2. However, under certain circumstances (including, in some cases, the loss of a job) child support obligations can be modified by the court. Given you employment situation, you may want to look into that option. For more general information, visit our Massachusetts Divorce Discussion Forum.
