I purchased a condo from the RE developer nine years ago. I have 23 % interest as a unit owner, but I was also appointed a trustee at the conveyance of the property. For the past nine years, I have been excluded from virtually all decision making in this association. The RE developer, who is the only other unit owner and trustee, ignores certified letters from me, requesting to see financial and insurance documents, and requesting we hold regular meetings. Meanwhile the property is deteriorating because the developer probably does not have the funds to keep up the property. We have had two Annual Meetings in nine years, and a history of disputes around the issues of property maintenance (that is, I want to hire licensed, professional contractors to perform work on this property; the developer uses unlicensed workers, who perform substandard work on this property). The only working budget we have is from the Annual Meeting four years ago. Meanwhile, I have sustained property damage (sagging ceilings and water damaged walls) to my unit as a result of two separate floods from the developer's unit. What is the statute of limitations on litigation for this claim, and what should I do about obtaining financial records.
