Leading up to the transfer of our condo association from the developer to a newly elected board, a group of people got together and called themselves a committee. They were not elected by the community but simply appointed themselves.
They hired an attorney, and asked for donations from unit owners to help with the expense.
The board was officially elected in November. Their first act was to officially hire the attorney to represent the association. Their second act was to reimburse the unit owners who had donated to the lawyers fees accrued from before they were elected.
Is the board allowed to do this? It seems to me from a legal standpoint the lawyer was initially hired by a group of individual unit owners and that the association is in no way responsible for those fees. Of course once the board was elected and officially hired the attorney the resulting expenses after that point would be the associations responsibility.
