In MA are commissions treated like wages? I worked Oct Nov and Dec of 2009 earned the commissions and left the company in Jan 2010 they are refusing to pay me saying that I needed to be employed at the time of commission payout although I never had heard of this policy.

Depends on the context. You can check out Massachusetts General Laws Chapter 149 (The Massachusetts Wage Act). Section 148, states that the Wage Act is applicable to the payment of commissions "when the amount of such commissions, less allowable or authorized deductions, has been definitely determined and has become due and payable to such employee . . ."
