A man has been sitting under the window of a friend's apt. She has called the police...he's gone when they arrive. I suggested she get a gun, hold him at gun point until the police arrive. But if he would come at her and she'd shoot him...I'm presuming she'd be arrested since she's not inside her apt. I told her to drag him inside before the police arrive but... So my question is: what can she do to get rid of him? Thank you so much for any help. River

Citizen's arrest

I'll assume that this question is posted by the same person that posted the question about using a gun to make a citizen's arrest of a graffiti artist (and that both questions are not intended as jokes).  I do not recommend using a gun in any way, and certainly not to effectuate a citizen's arrest.  Massachusetts law allows citizen's arrests in very limited circumstances, primarily when a person witnesses the commission of a felony.

No, I'm not the same person. And this is a very real situation. I wasn't asking for an opinion on the use of a gun. I did some research and now know that a gun can only be used for self-defense inside one's home. So scratch that question or actually more of a comment, sorry if readers found it confusing.

I am asking for suggestions on what my friend can do to get rid of this man that sits under her windows night after night.
