My tenants who were on a month to month tenancy are moving out a few days after a notice to vacate the premises have expired. Can I charge for the additional days that they remained in the house. They were scheduled to be out the 15th of August and is leaving on the 22nd of August. Would that be counted as 8 days(15-22); 7 days(15-21)or 6 days(16-21). I want to make sure that I am not overcharging to later be faced with a lawsuit for an honest mistake.

I would charge for any day that they are actually in possession of the premises.  So the answer depends on when they move out and give you the key.  If they paid rent through and including the 15th, then charge for the 16th through the 22nd.  Good luck.
