A defendant, on a second DUI charge, pleaded Guilty the charges - received 3 months sentence to be served. 2 years probation ans loss of License for 2 years. The defendant then went back and changed the plea to NOT GUILTY and asked for a Jury Trial - which was granted. What statute or reason is there for this?? Seems strang to go before the Judge and pleading stating that they understood the penalties involved??

Not sure I have the facts straight, but typically under MA law, once the court accepts the plea and sentences the defendant, it is too late to change the plea absent some extraordinary circumstances. Good luck, and please tell your friends about The Forum.
