Is there a minimum that must be paid for Commission-Based work? I am a car salesman and our weekly salary has been reduced by $100 from $300 to $200. We do make a percentage off of every car we sell, however, as one can imagine, this economy is not conducive to large amounts of car sales. In addition, there is a drawer that can be taken, however it must be repaid the following week and I am not sure if that drawer is available to be taken every week, especially if one does not sell any cars.

This is a somewhat complicated area of the law involving both federal and Massachusetts employment law. Unfortunately, I do not have an answer for you. I believe that in-house sales staff are covered by the minimum wage laws, but the complications arise in figuring exactly what you are earning in any given period and whether, combined, all sources of your income satisfy the federal and Massachusetts wage laws.
