If i am told by my wife to move out of home because she wants a divorce,Her grounds are I deal with a chronic form of depression that has been recently medically brought under control and has stabilized after intense therapy requiring inpatient care. This has caused me to at times not to be able to work. There has never been any form of abuse in twenty three yrs. of marriage. Do i have to leave my home. Thank You.

No, assuming this is a typical situation (house is in the name of both parties and no restraining order has been issued by a court as the result of domestic abuse) you do not have to leave the house. In Massachusetts, as in most states, until the family court issues an order relevant to the marital home, both parties have equal rights to it and can remain there. If one party changes the locks, the other party can call the police and regain entry to the home. For more information or to post a question, visit our Massachusetts Divorce Discussion Forum.
