I have my boyfriend living with me and he got in a fight with the neighbor. Now the landlord says he is going to evict us BOTH. That doesn't seem fair or right. Does Massachusetts law allow him to evict ME because of something my guest did?

Massachusetts courts have held that a landlord can hold a tenant responsible for the actions of, or problems caused by, her guests. So, if your guest has done something that would warrant eviction if you did it, then the landlord may be able to evict both of you. See, for example, Spence v. Gormley, 387 Mass. 258, 439 N.E.2d 741 (1982). For more information or to post a question, visit our Massachusetts Tenant Law Discussion Forum.
