In some situations, Massachusetts law requires one spouse to contribute to the cost of the other spouse’s divorce attorney. Massachusetts General Laws Chapter 208, Section 17 states: “The court may require either party to pay into court for the use of the other party during the pendency of the action an amount to enable him to maintain or defend the action.” For this section to apply, one party must show that he does not have sufficient income or assets to pay for an attorney and that the other party does. To facilitate this showing, the Probate and Family Court can order both parties to file financial statements.
