OK I'm not really sure how this works. I've been very ill and used all my money to pay debts. Lost my job because I couldn't work and I'm still waiting to hear about disability. So can a person who does not have a job file for bankruptcy even though I can't pay any money back to the creditors?

Yes, you can file bankruptcy when you are unemployed. I think your are confused because of the difference between Chapter 7 bankruptcy and Chapter 13 bankruptcy. Chapter 13 bankruptcy does include a repayment plan, and you would need some income to meet requirements of the plan. In a Chapter 7 bankruptcy, however, the debtor seeks a discharge of his debts. For a better understanding of whether you qualify for a Chapter 7 bankruptcy and whether it will work in your situation, you should really talk to a MA bankruptcy attorney. good luck.
