Can I file bankruptcy if I didn't file income taxes last year?

Because of my screwed up money situation, I stupidly decided not to file my taxes last year. I don't even know if I owed taxes but my finances were so messed up I just blew it off. Can I still file bankruptcy?

Yes, you are going to have to

Yes, you are going to have to file your taxes before filing for bankruptcy. If you are getting money back you will need to account for the asset. If you owe you then you will have to account for the debt, but it will not be discharged.

Good luck.

Yes......BUT

You can certainly file bankruptcy...However, once you file you will have to complete the filing of your taxes as soon as possible. Once your case is assigned to a Trustee (an overseer of your case) he/she will request a copy of the most recent, and often times the last 3 years of tax returns in order to help them get a better picture of your financial situation. If a foreclosure is about to take place in a few days you can still file even without the filed form....just make sure that you file it once you have sought relief form the bankruptcy code.

Best of luck, Avi Liss
